COURT DISMISSES FRAUD COMPLAINT AGAINST NEW YORK DIVORCE LAWYER: STUART STRUMWASSER V. LISA ZEIDERMAN

            In a decision issued on November 23, 2011, the Supreme Court (New York County) dismissed Stuart Strumwasser's fraud complaint against attorney Lisa Zeiderman, who was the divorce lawyer for Mr. Strumwasser's former wife.  Mr. Strumwasser's complaint alleged that defendant Zeiderman and her law firm had been "deceitful" in "represent[ing] that Snow Beverages [Plaintiff's company] was profitable since, at the time of the divorce proceedings, it was losing money."  Strumwasser's complaint alleged that he was induced to settle the divorce action because litigation regarding Snow Beverages' appropriate valuation would have been costly, complicated, and unaffordable.

WHICH SPOUSE IS ENTITLED TO CLAIM CHILDREN AS DEPENDENTS FOR INCOME TAX PURPOSES?

            Unless a marital settlement agreement or divorce judgment provides otherwise, the  parent who has physical custody is entitled to claim the children as dependents on his or her income tax returns.  However, many marital agreements and divorce judgments specifically provide that the payor (noncustodial) parent is entitled to claim the children as dependents, or that the parties will each claim one child.

            New York divorce has now had a no-fault ground of divorce for more than a year.  As a New York divorce lawyer, I enthusiastically welcomed the advent of no fault divorce, believing that it would help reduce the cost, stress and general unpleasantness that is frequently associated with divorce. New York was the last state in the United States to pass no fault divorce.  New York has also long been famous as one of the most expensive and difficult places in the United States to get a divorce.  Since a year has passed, it is now time to ask: Did the advent of no fault divorce in New York live up to its expectations?
